Our Personal Data Protection and Processing Policy

We at Gemciler Güven Metal A.Ş. are concerned about the safety of your personal information. In light of this, the Company places a high priority on processing and keeping all types of personal data belonging to all individuals who are affiliated with the Company in compliance with Personal Data Protection Law No. 6698 ("PDPL"). We process your personal data as described below and within the parameters set forth by the law in our capacity as "Data Controller" as that term is used in the context of the PDPL.

In this clarification text;

Personal Data: Refers to any information relating to an identified or identifiable natural person,

Personal Data Protection Law ("PDPL"): Refers to the Law No. 6698 on the Protection of Personal Data, which entered into force as published in the Official Gazette on 07.04.2016,

Data Controller: Refers to the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system,

Data Processor: Refers to the natural or legal person who processes Personal Data on behalf of the Data Controller based on the authorisation granted by the Data Controller.

Pursuant to the PDPL, the personal data you share in the capacity of interlocutor, member, donor, scholarship recipient, intern, supplier, visitor, grant recipient, award recipient, supported, programme partner and/or employee/manager will be evaluated by the Gemciler Güven Metal A.Ş. legal entity determined as the data controller within the scope specified below.
  • The goal of Gemciler Güven Metal A.Ş. is to handle your personal information in compliance with other laws and the terms of Law No. 6698 on the Protection of Personal Data ("PDP Law"). Your personal information may be gathered verbally, in writing, or electronically through automatic or manual techniques, our Company's units, website, social media platforms, mobile applications, or other similar ways, depending on your relationship with our company. As long as you have a relationship with our company, your personal data will be collected, updated, and processed. Your personal information will be handled when you visit our business or website, when you attend trainings, seminars, or events that our business sponsors. Your personal data that you have notified or will notify to us and/or your personal data obtained by our company as Data Controller in any way;
  • Shall be within the framework of the purpose that requires the processing of your personal data and in connection with this purpose, in a limited and measured manner,
  • Shall maintain the accuracy and the most up-to-date version of the personal data you have notified or as notified to our Company.
  • We hereby declare that it will be recorded, stored, preserved, reorganised, shared with the institutions legally authorised to request such personal data and transferred to domestic or foreign third parties under the conditions stipulated by the PDP Law, transferred, classified and processed in other ways listed in the PDP Law and may be subject to other transactions listed in the PDP Law.
Your personal data collected will be processed in accordance with the following rules in accordance with the personal data processing conditions and purposes specified in Articles 5 and 6 of the PDPL for the purposes of carrying out the necessary work by the relevant business units for you to benefit from the services of our Company, ensuring the legal and commercial security of our Company and the persons who have a business relationship with our Company, determining and implementing the strategies of our Company and ensuring the execution of our Company's human resources policies:
  • In accordance with the law and good faith,
  • Accurate and, where necessary, up to date,
  • For specific, explicit and legitimate purposes,
  • Relevant, limited and proportionate to the purpose for which they are processed,
  • Retention for the period stipulated in the relevant legislation or required for the purpose for which they are processed,
It will be processed in accordance with the rules.
Your collected personal data may be transferred to our business partners, suppliers, authorised employees, legally authorised public institutions and legally authorised private persons, third parties deemed necessary, foreign companies that we cooperate with, for the purposes of carrying out the necessary work by the relevant business units for you to benefit from the services of our Company, ensuring the legal and commercial security of our Company and the persons in business relations with our Company, determining and implementing the commercial and business strategies of our Company and ensuring the execution of our Company's human resources policies, within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the PDPL.
Your personal data is obtained in all kinds of verbal, written or electronic media in order to provide our services in line with the above-mentioned purposes and to fulfil our Company's contractual and legal obligations in a complete and accurate manner. Your personal data collected for this legal reason can also be processed and transferred for the purposes specified in Articles (1) and (2) of this text within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the PDPL.
As personal data owners, if you submit your requests regarding your rights to our Company by the methods set out below, our Company will finalise your request free of charge within 30 days at the latest depending on the nature of the request. However, if a fee is stipulated by the Personal Data Protection Board, the fee in the tariff determined by our Company will be charged.In this context;

What are your rights as a personal data owner?

Pursuant to Article 11 of the PDP Law, data owners have
  • The right to learn whether personal data is processed or not,
  • The right to request information if personal data has been processed,
  • The right to learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  • The right to know the third parties to whom personal data are transferred at home and abroad,
  • The right to request correction of personal data in case of incomplete or incorrect processing,
  • The right to request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the PDPL,
  • The right to request notification of the transactions made pursuant to subparagraphs (e) and (f) and the third parties to whom personal data are transferred,
  • The right to object to the occurrence of a result to the detriment of the person himself/herself by analysing the processed data exclusively through automated systems,
  • The right to demand the compensation of the damage in case of damage due to unlawful processing of personal data.
You may submit your request for exercising your above-mentioned rights to our Company in writing or by other methods determined by the Personal Data Protection Board in accordance with Article 13, Paragraph 1 of the PDPL. Since the Personal Data Protection Board has not determined any method at this stage, your application must be submitted to our Company in writing in accordance with the PDPL. In this context, the channels and procedures to submit your written application to our Company within the scope of Article 11 of the PDPL are explained below.
  • By personal application of the Applicant,
  • Through a notary public,
  • Signed by the Applicant with the "secure electronic signature" defined in the electronic signature law numbered 5070 and sent to the registered mail address of our Company or to the PDPL contact address of our company

Your applications submitted to us will be answered within thirty days from the date of receipt of your request, depending on the nature of the request, in accordance with Article 13, Paragraph 2 of the PDPL. Our responses will be delivered to you in writing or electronically in accordance with the provision of Article 13 of the PDPL. You can send your request, which includes the necessary information to use your rights mentioned above and to identify your identity and your explanations regarding the right you request to use from the rights specified in Article 11 of the PDPL, to our company in a clear and understandable manner by the methods described above.
